Bay Harbour at Bay
A Lee County Hearing Examiner issued a scathing 53-page report
against the proposed Bay Harbour Marina Village mixed use development
for San Carlos Island last week. Hearing examiners are local
administrative agency employees who serve as judges to resolve conflicts
in their jurisdiction. The hearing examiner’s ruling is not a final
decision, but a neutral place to vet development before it reaches the
Lee County Board of County Commissioners for a vote. “As proposed, the Request cannot be approved because the Request does
not comply with the Lee Plan,” wrote Hearing Examiner Laura Bellflower.
“It is inconsistent with the Lee Plan directives for residential
densities in the Coastal High Hazard area; does not comply with the Lee
Plan definitions of ‘density, ‘mixed use, and ‘mixed use building’; is
incompatible with and negatively affects the character of the
surrounding neighborhood; and creates unsolved transportation and

The southern end of Estero Island is home to The Little Estero Island
Critical Wildlife Area (CWA), a 50-acre protected beach habitat that
features a vast array of shorebirds unlike any other place on earth. Two
property owners however, are seeking a Department of Environmental
Protection (DEP) permit to construct a private beach boardwalk to the
Gulf of Mexico that could imperil this endangered natural habitat. The Town of Fort Myers Beach became aware of the boardwalk permit when
Rae Blake, its environmental and stormwater technician, learned of the
project known as Beach Boardwalk on September 29. After sending a
preliminary petition for a hearing, she informed Town Council at its
October 3 meeting because DEP allows just 14 days to respond before

Conservation 20/20 Referendum on November Ballot
Conservation 20/20 is Lee County’s environmentally-sensitive land
acquisition and stewardship program, initially approved by voters in
1996. It preserves and protects critical parcels for drinking water,
nature-based recreation, flooding areas and wildlife habitat to benefit
present and future generations. Last year Lee County Commissioners
decided to place Conservation 20/20 as a non-binding referendum on the
November 8, 2016 ballot to let voters decide if it should continue,
though the Board is not bound by the outcome. A “yes” vote means you approve of Lee County using general revenue
funds to acquire, restore, improve and manage land for conservation,
surface water management, water quality, water recharge and supply,
flood control, wildlife habitat, passive public recreation and open
space purposes according to Ordinance 15-08, known as the Lee County
Conservation 20/20 Land Program. A “no” vote could alter the current

Construction Look Ahead - Week of October 24, 2016 Contractors for the Town of Fort Myers Beach and Lee County are installing new water main, and sanitary sewer force main, storm drainage, sidewalk and rebuilding roadway on Estero Boulevard from Crescent Street to Madera Road. Two travel lanes are expected to remain open the majority of the project; however, motorists may experience daytime and nighttime one-lane traffic on Estero Boulevard. Flaggers will alternate traffic frequently, but motorists should expect delays. Crews are expected to work Monday through Friday and most Saturdays. Construction will be year-round.
