Newsrack Ordinance Final Hearing
On Monday, December 18, the Fort Myers Beach Town Council will hold
the final hearing on Ordinance 17-14, a set of rules governing
newsracks. The ordinance would set limits on the size, location,
identification and condition of any container that holds any type of
periodical or newspaper, including daily and weekly newspapers,
shoppers, real estate guides, coupon books, magazines, tourist maps and
visitor guides. If it is distributed via a rack, stand or box, it will
be subject to this ordinance. The first Public Hearing on the newsrack ordinance was held August
14, followed by a discussion of the topic at the Council’s August 24
Management and Planning meeting. The planned Final Hearing was set for
September 7 and rescheduled due to Hurricane Irma’s imminent arrival. On
November 6, council opened the Final Hearing, but after discussion and
hearing from local newspaper representatives, agreed to table the
hearing and have Mayor Dennis Boback meet with Town staff and
representatives of local newspapers to attempt to develop a workable
draft.
TPI Announces Downtown Plan Ready
TPI Hospitality submitted their Commercial Planned
Development (CPD) application to the Town of Fort Myers Beach in late
March of this year for the 5.9 acres of property they own in the
downtown area of Fort Myers Beach. It is the third version of a plan to
revitalize an area that had been devastated by Hurricane Charley in 2004
and never quite recovered. Last month the final application was
submitted, ready for review by the Local Planning Agency and Town
Council in the coming months. In the eight months since March, TPI and Town staff have worked on
reviewing the plan, adding information and essentially fine-tuning the
application for presentation to first the Local Planning Agency,
expected in February, and then Town Council. The Town brought consultant Bill Spikowski onboard in July to assist
with the evaluation of the plan. As the author of the Town’s original
Land Development Code, Spikowski was tasked with performing a technical

New Year’s Eve Fireworks a Go
Near the end of Council’s Management & Planning Session Thursday, December 7th,
Mayor Dennis Boback stated the volunteer Fireworks Fundraising
Committee had raised $20,000 for fireworks at midnight on New Year’s
Eve, to dovetail with the Town’s plans to celebrate its 22nd
birthday and Beach Ball Drop in Times Square to ring in the New Year.
This immediately spurred debate among Council, with Council member
Joanne Shamp having already exited for an appointment. “The Fireworks Committee say they secured $20,000 for the show,”
Boback said. “If they turn this in to the Town by Friday, December 8, at
5 p.m., we can assist in permitting.” He confirmed on Saturday,
December 9, that the Town had received this payment. On December 31st, New Year’s Eve, the Town hosts its
annual Birthday Cupcakes distribution in Times Square from 11 a.m. to 1
p.m., with a photo booth and dunk tank. At midnight, it has the
traditional Beach Ball Drop to usher in 2018, with security,
port-a-potties, refuse dumpsters and Fort Myers Beach Fire Control
District coordination for the expected large crowd, with The Times
Square Merchants Association providing live music from noon-midnight on
