Code Enforcement or Compliance?
Town Policy Creates Confusion & Frustration
Code Enforcement for the Town of Fort Myers Beach traditionally was on a complaint-driven basis. Town personnel, however, recently began a process to seek out violations where no complaint has been received. It sees this as a proactive formula to enhance property values, while those on the other side of the equation feel there may be a vindictive element to the process. “I requested that our Code Enforcement team begin at the north end of the island and work their way southward, to identify potential violations,” said Town Manager Roger Hernstadt.” “The most common issues so far have to do with parking, as the island has legal parking lots and others that are not fully authorized, so we need to protect those parking lots that have spent a lot of time and money to come into compliance, meaning we are obligated to bring those other lots up to that same level, out of fairness. We are also trying to identify commercial properties that use the Town Right-of-Way for overflow parking without a permit or agreement with us. It is my job to implement the laws and policies of the Town Council, and we try to be proactive while preventing community issues. That said, we will do our jobs diligently until such time that Council modifies the code or policy.”  CONTINUE READING


Long Term Solution for Short Term Rentals
After months of debate over Short Term Rentals, the Fort Myers Beach Town Council passed an updated Ordinance in a divided vote before roughly 25 people on Monday, May 7, 2018 at 9 a.m. In a separate action during its ambitious agenda, Council adopted the Short Term Rental Registration Fees in a majority vote. Council began its 2nd Reading & Final Public Hearing for Short Term Rental Regulations with Public Comment. Jessie Titus was one of four people to speak against it, asking why the Town does not enforce its current regulations, “since the Town had not one single complaint ever!” Dave Ennis, however, was one of two speakers in favor. He no longer wants crying children all day and 15 to 20 people partying every night, “so I don’t see anything wrong with this.” Council member Bruce Butcher believed it unnecessary for each individual condominium unit to register, with Mayor Tracey Gore stating that an Ordinance option, if approved by Council, would allow condominiums to opt out in favor of administering their own regulations that are often more strict than those proposed by the Town. Council member Dennis Boback met in March with representatives of 30 condominium associations on Fort Myers Beach, and 27 support having condominiums in the Ordinance, to help enforce their rules. His bigger issues are complaints and enforcement: “You cannot complain anonymously; you must identify yourself so you can’t put anyone out of business with false claims.”  CONTINUE READING
